Terms of Business
1.1 These conditions shall apply to all contractors with Ages of Elegance (AOE) to the exclusion of all other terms and conditions, including those on any purchase order or similar document.
1.2 Receipt of a deposit and completed order form shall be deemed as an acceptance of these terms and conditions.
1.3 Deposits are non refundable.
1.4 Goods are sent by carrier or registered post. Acceptance of delivery of the goods shall be deemed conclusive evidence of the buyer’s acceptance of the goods.
1.5 Any delivery date stated by AOE is an estimate only and is not to be the essence of the contract.
1.6 Claims for goods received damage should be made within 3 days of despatch.
1.7 The buyer shall be deemed to have accepted goods 24 hours after delivery to the buyer. Unless picked up in person which is deemed to be acceptance
1.8 After acceptance the buyer shall not be entitled to reject goods.
1.9 When the buyer has been deemed to have accepted the goods then the AOE shall have no liability whatever to the buyer in respect of those goods.
2.1 AOE is not liable to the buyer or for loss of profit due to late delivery of goods.
2.2 No goods delivered to the buyer which were in accordance with the contract will be accepted for return without the prior written approval of the AOE on terms to be determined at the absolute discretion of the AOE.
2.3 If AOE agrees to the acceptance of the acceptance of any such goods for return, the buyer will be liable to pay for the carriage. All such returns are at buyer’s risk.
2.4 Prices are for basic items only (unless already negotiated) and any extra work including decoration, wrong spex or patterns given will be added to bill.
2.5 Prices are for machine-made hand-finished garments. For fully hand-made garments prices on request.
2.6 Prices do not include materials or carriage costs; these will be added to final bill.
2.7 Fittings to take place at my workshop, unless otherwise stated. If elsewhere, then travel will be charged, as will time at £15 per hour. If fittings other than at my workshop are cancelled at the last moment, then time lost will also be charged at £15 per hour. At least 3 fittings are generally necessary for the completion of garments. If this is not possible for any reason then no responsibility can be taken if garments do not fit as well as hoped, particularly if I have also not been able to measure you, although every effort will be made to ensure that no problems occur
2.8 An initial deposit is required before work can commence, with additional payments when necessary. On expensive orders fabric costs must also be paid at start of work.
2.9 Cancellation of order will not be accepted once it has been confirmed, although alterations to the order of the same value can be made.
3.0 Goods will not be released until final payment has been received, (unless otherwise negotiated) in which case payment to be made within 7 days otherwise interest payments of 15% apr overdue will accrue. Goods remain the property of Dawn Wood Costumes until fully paid for.
3.1 Cheaper prices for bulk orders, children’s’ sizes, or “one size fits all”, are possible.
3.2 Please note, at least 3 months outside notice is required of an order, (longer on bulk orders) otherwise delivery cannot be guaranteed. If overtime is necessary to finish garments ordered after this period, to comply with a given completion date, it will be charged at the rate of 20% and added to the final invoice.
3.3 Work will not commence until deposit has been paid. Any delay in receiving this, which means that overtime becomes necessary to meet deadlines will be charged extra and added to final costs as above.
3.4 Whilst every effort is made to reproduce clothing as accurately as possible we cannot guarantee absolute authenticity, as modern manufacturing techniques mean that materials, dyes etc are made in a different way giving a lighter weight of fabric and finish.
3.5 AOE reserves the right to charge for any drawings and/or designs in the event of no order resulting and/or such drawings or designs not being returned.
3.6 Where lace, metalwork etc are manufactured by outside suppliers AOE accepts no responsibility for losses incurred by delays.
3.7 AOE reserves the right to charge for any research needed to complete an order where insufficient material is supplied by the buyer.
